An analysis and evaluation of the legislative framework of public procurement legislation in the European Community leads to 2 main conclusions:

  1. The Community's effort to make public procurement conform to the fundamental treaty provisions prohibiting obstacles to the free and undistorted flow of goods and services throughout the common market is a promising attempt. Despite the existence of shortcomings and inadequacies in the legal regulation of public sector contracts, it will produce results in the near future.
  2. The results of these efforts will not change the ingrained habits of nationalistic procurement immediately. The rule of the European Court of Justice and of national courts with respect to the interpretation, correct application, and award of compensation to aggrieved parties will be important.
